A comprehensive Trust package will dictate your plan to protect your Legacy and clarify your beneficiaries of your Trust assets. When a person passes away, the successor trustee of your Trust will execute your trust and pay for all your expenses, including taxes, and will distribute your assets as you have expressed in your Trust. .

If a person dies with or without a Will, if any of the decedent’s assets are not in the Trust or does not name a beneficiary or a joint owner, a Probate with the court is required to access those financial assets. To avoid Probate, periodic review of your financial accounts could avoid Probate.

When a person becomes unable to make financial decision due to incapacity, a conservator may be appointed by the court to pay for or access that person’s financial assets. If that person executes a Durable Power of Attorney before they are deemed incapacitated, the court involvement can be avoided.

Long-term care benefits for Medicaid and Special Needs planning can be accessed and can be preserved. Understanding the eligibility rules for Medicaid, Social Security disability, Veterans benefits, and other welfare benefits programs are important to plan for elders and special needs individuals.
